How to Appeal a Refusal to Assess Decision

Step 1: Understand the reason for the Decision

The Local Authority has 6 weeks to decide whether to assess after you request an EHC needs assessment. If they refuse, they’ll send a written decision letter detailing their reasons why- the date on that letter starts the appeal clock.

Step 2: Check the Deadline

You must submit your appeal within:

2 months from the date of the refusal letter, or
1 month from the date of your mediation certificate. Whichever date is the latest.

Step 3: Get a Mediation Certificate

Before appealing a refusal to assess decision, you have to contact a mediation adviser.

You can then choose to either:

Attend mediation with the LA, or
Choose not to and receive a mediation certificate confirming you’ve declined. This certificate is mandatory to proceed with the appeal.

So what exactly is an EHCP? An EHCP is an acronym which stands for Education, Health, and Care Plan which is a legal document in the United Kingdom that is there to support children and young people aged 0-25 with special educational needs and/or disabilities.

An EHCP describes a child/ young person's individual needs and specifies the support and provision needed to help them achieve their educational and healthcare goals. They are for children/ young people whose needs can't be met via the usual SEN support in their

For children and young people with special educational needs or disabilities, an Education, Health, and Care Plan ensures that they receive the support and services necessary to flourish academically and personally.

Does Your Child Have SEN?

The EHCP process starts with identifying children and young people who may require additional support due to special educational needs or disabilities that can’t be met without an EHCP. This can be observations by parents, teachers, medical professionals, or formal assessments. Once the need for support is identified, a request is made to the LA to ask for a needs assessment. This can be done by filling out an application form on the local authority’s website or drafting a letter.

Requesting The Needs Assessment

Parents, carers, the school, or even the young person themselves (if over 16) can start the EHCP process by requesting a needs assessment from the local authority. This request prompts the local authority to evaluate whether an in-depth assessment is warranted. If the LA agree to assess, they will send professionals to assess the child/young person. If not, they may refuse to assess, and you have the option to appeal. You should have an answer within 6 weeks of applying.

The Needs Assessment

A thorough evaluation occurs if the local authority determines that an assessment is necessary. This assessment draws information from various sources, including parents, the individual, teachers, medical professionals, and experts like an Educational Psychologist or Speech Therapist, depending on the child/young person’s needs. Its purpose is to understand the child/young person’s needs and what provision is needed to meet those needs.

Drafting The EHCP

The coordinator will gather all supporting documents from the needs assessment and a panel will usually decide the outcome based on the assessment's findings if an EHCP is necessary. If so, a draft document will be created. This document outlines the child/young person’s specific needs, the desired outcomes, and the range of support and services required to meet those needs. The EHCP will also describe the educational setting best suited to meet the individual's needs

Making Representations On The Draft

The draft EHCP is shared with parents and the child/young person (if applicable). This step allows you to make representations of the plan. Finalising the EHCP

EHCP - PHASE TRANSFERS

Phase transfer of an EHCP refers to the process of transitioning a student with special educational needs and disabilities from one educational setting to another. This phased approach is used when a student is moving from one school or educational phase to another, such as transitioning from primary school to secondary school, reception to Primary school, infants to juniors etc.

The phase transfer process begins with careful planning and collaboration between the current and receiving educational settings, Local authorities, parents or carers, and relevant professionals involved in your child's support. This includes sharing information, reviewing the EHCP, and identifying the specific needs and support requirements during the transition. We can support you during this stage.

The phase transfer deadlines are 15th February and 31st March (post-16 transfers) for that school year. Keep these dates in your calendar, as a few months prior to these dates, an annual review should be held with the school and local authority to discuss the transition. This is where you can start thinking about naming a suitable school placement in your child's EHCP when you receive a copy of the draft plan.

Continuously monitor and review your child's progress and the effectiveness of the support provided during the phase transfer. Adjustments to the EHCP or support strategies may be necessary based on the student's needs or challenges during the transition. Who are SENDIST?

So, what is SENDIST? SENDIST stands for the Special Educational Needs and Disability Tribunal. SENDIST deals with appeals from parents/carers/young people against decisions made by local authorities regarding their special educational needs.

The great thing about SENDIST is that it is impartial, accessible and fair. They will have a lawyer and panel members with expertise in SEN law and pract ice. This allows all parties to present their case and provide evidence to support their arguments. The tribunal's decisions are legally binding and they can also order changes to the SEN provision or placement for the child or young person.

The tribunal process usually involves completing an appeal form, submitting relevant documents and evidence, and attending an oral/ paper hearing where parties involved in the appeal can present their arguments.
