           Step 1: Understand the reason for the Decision
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/h3&gt;&#xD;

           The Local Authority has 6 weeks to decide whether to assess after you request an EHC needs assessment. If they refuse, they’ll send a written decision letter detailing their reasons why- the date on that letter starts the appeal clock.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           Step 2: Check the Deadline
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           You must submit your appeal within:
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ul&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;strong&gt;&#xD;
        
            2 months
           &#xD;
      &lt;/strong&gt;&#xD;
      &lt;span&gt;&#xD;

             from the date of the refusal letter, or
            &#xD;
        &lt;/span&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;strong&gt;&#xD;
        
            1 month
           &#xD;
      &lt;/strong&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;span&gt;&#xD;
          
             from the date of your mediation certificate. Whichever date is the latest.
            &#xD;
        &lt;/span&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ul&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           Step 3: Get a Mediation Certificate
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Before appealing a refusal to assess decision, you have to contact a mediation adviser.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           You can then choose to either:
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Attend mediation with the LA, or
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Choose not to and receive a
           &#xD;
      &lt;/span&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;span&gt;&#xD;
          
             mediation certificate
            &#xD;
        &lt;/span&gt;&#xD;
      &lt;/span&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;span&gt;&#xD;
          
             confirming you’ve declined. This certificate is mandatory to proceed with the appeal.
            &#xD;
        &lt;/span&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ul&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;

            If you’re a parent trying to secure an EHCP for your child, you’ve probably already heard this word thrown around:

           One of the biggest reasons is that Local Authorities are often under extreme financial pressure. Demand for EHCPs has risen sharply in recent years, but the funding hasn’t kept up. As a result, some LAs intentionally make the process deliberately difficult, hoping only the most persistent parents will continue to push. It’s not right but it’s happening all over the country.

           Even though you’re not a legal professional, medical expert, or educational psychologist, the system often expects you to behave like one. You’re expected to gather evidence, chase reports, attend meetings, and spot errors in complex documents. For children and young people with special educational needs or disabilities, an Education, Health, and Care Plan ensures that they receive the support and services necessary to flourish academically and personally.

This can be done by filling out an application form on the local authority’s website or drafting a letter.

Its purpose is to understand the child/young person’s needs and what provision is needed to meet those needs.

           Drafting The EHCP

           The coordinator will gather all supporting documents from the needs assessment and a panel will usually decide the outcome based on the assessment's findings if an EHCP is necessary. The EHCP will also describe the educational setting best suited to meet the individual's needs

           "I found Linda when I was feeling quite overwhelmed by the complexity of navigating the system in working to get my year 9 son’s EHCP reviewed at an emergency review.

Choosing how, when and if to go into battle has been key in this process.

I fear without Linda’s focus I may have been trying to fight too many battles at once and the may have risked losing the opportunity to extricate my son in the most efficient way. We were able to secure 3 wins at the review… including an agreement for a move to a specialist SEN provision. We are now in the consultation process and I am confident that we have done all we could have to this point to ensure the most positive outcome for my son. This is a painfully complicated process for any parent - but I knew that when Linda was involved it would be focused , concise and on point. Thank you Linda"

           If the local authority does not follow EHCP timescales, it can significantly delay providing necessary support and provisions for children with special educational needs (SEN). It is important to take appropriate action to address the situation and ensure that your child's rights are protected. Here are some steps you can take:

  &lt;/p&gt;&#xD;

    &lt;span&gt;&#xD;

           4. To start the appeal process, you must register your appeal with the Special Educational Needs and Disability Tribunal. The SEND Tribunal is an independent body that handles appeals related to EHCPs.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           5. There are strict time limits for registering an appeal, usually within two months of receiving the local authority's decision, or one month from the date on the mediation certificate. Ensure all the relevant paperwork is attached when you lodge your appeal. Do not forget to add a copy of the mediation certificate and LA decision letter.

           Phase transfer of an EHCP refers to the process of transitioning a student with special educational needs and disabilities from one educational setting to another. This phased approach is used when a student is moving from one school or educational phase to another, such as transitioning from primary school to secondary school, reception to Primary school, infants to juniors etc. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The phase transfer process begins with careful planning and collaboration between the current and receiving educational settings, Local authorities, parents or carers, and relevant professionals involved in your child's support. This includes sharing information, reviewing the EHCP, and identifying the specific needs and support requirements during the transition. We can support you during this stage.

           (post-16 transfers) for that school year. Keep these dates in your calendar, as a few months prior to these dates, an annual review should be held with the school and local authority to discuss the transition. This is where you can start thinking about naming a suitable school placement in your child's EHCP when you receive a copy of the draft plan.

            Continuously monitor and review your child's progress and the effectiveness of the support provided during the phase transfer.            The great thing about SENDIST is that it is impartial, accessible and fair. They will have a lawyer and panel members with expertise in SEN law and pract

           ice. This allows all parties to present their case and provide evidence to support their arguments. The tribunal's decisions are legally binding and they can also order changes to the SEN provision or placement for the child or young person.
