Understanding the EHCP and SEND Framework

The Children and Families Act 2014 provides the legal framework for Education, Health and Care needs assessments and plans in England. The SEND Code of Practice: 0 to 25 years is statutory guidance for organisations including local authorities, schools, colleges and certain health bodies. Keep a clear record of what happens at home and at school, such as distress, anxiety, exclusions, part-time timetables, refusal to attend, sensory overload, communication issues, friendship struggles, academic gaps, or tiredness after school.

Evidence might include:

· School reports, attainment data, behaviour logs, attendance records, or incident reports.

· Emails between you and the school about concerns or support.

· Your own diary of what your child finds difficult and how this affects daily life.

What the SEND Code of Practice Says About SEN Support

The SEND Code of Practice is official guidance for schools and local authorities in England when helping children with special educational needs. It matters because it shows that SEN Support should not be vague or informal. Schools need to take clear, purposeful action that matches your child’s needs and aims for better results.

In reality, schools shouldn’t just say, “We are keeping an eye on things,” or, “They are managing.” If a child has or might have SEN, the school should show what needs they have found, what support is in place, who is giving it, how often it happens, and how they check if it’s working.

The SEND Code of Practice describes a graduated approach, often known as assess, plan, do and review. This should be a cycle, not a one-off conversation. School should assess your child’s needs using evidence, plan support with clear outcomes, put that support in place, and then review whether it has made a difference. Parents and, where appropriate, the child or young person should be involved in this process.

If the school disagrees with you, this framework can help shift the conversation from opinions to facts. You can ask: What was assessed? What was planned? What was actually done? What was reviewed? What changed afterward? If these answers aren’t clear, it may mean SEN Support hasn’t been properly organised or reviewed yet.

Sometimes, disagreements about an EHCP request happen because the school thinks it can meet your child’s needs with its own resources. The SEND Code of Practice doesn’t require a child to fail before getting more help. Schools should spot needs early, remove learning barriers, involve families, and review support regularly. If your child still isn’t making progress or their needs are too complex for regular SEN Support, this can help your case for an EHC needs assessment.

Step 3: You Can Apply Directly to the Local Authority

You don’t have to wait for the school to agree before asking for an EHC needs assessment. Parents, carers, young people aged 16 to 25, schools, or other professionals can make the request. In your letter or online form, describe your child’s needs, what support has been tried, why it wasn’t enough, and why you think an EHCP is needed.

After the local authority gets your request, it must decide whether to do an assessment. If it agrees, the whole EHCP process should be finished within 20 weeks from when your request was received. If it refuses, you should be told about your right to mediation and appeal.

Step 4: Keep Communication Professional and Written

It’s normal to feel upset if you think your child is struggling and the school doesn’t see everything. Still, keeping your communication calm, clear, and in writing can help protect your position. If the local authority refuses to do an EHC needs assessment, it’s not the end of the process. The refusal letter should explain the reasons, what evidence was looked at, and how you can challenge the decision. Usually, you’ll need to try mediation before appealing to the SEND Tribunal. Watch deadlines closely and get advice quickly if you’re unsure.

When deciding whether to assess, the local authority should look at whether your child has or might have special educational needs and if they may need extra support through an EHC plan. This is a lower bar than many parents think. You don’t need the school’s permission to ask for an assessment, and you don’t always need a diagnosis before applying.

If School Still Disagrees

Sometimes, even after you share evidence, the school may still believe SEN Support is enough. If this happens, try to keep your relationship with the school separate from your right to ask for an assessment. You can keep working with the school and also make your own request to the local authority.

You might want to ask the school for copies of your child’s records, support plans, assessment data, behaviour logs, attendance details, and notes from review meetings. If the school disagrees with you, it doesn’t mean your concerns aren’t valid. It just means you may need to show your evidence clearly and explain the difference between how your child seems at school and what you see at home.

· Collect school evidence, professional reports, emails, examples of work, and your own diary notes.

· Explain what support has already been tried and why it has not been enough.

If you’re a parent trying to secure an EHCP for your child, you’ve probably already heard this word thrown around: “battle.” And if you're in the thick of it, you know it's not an exaggeration.

So what exactly is an EHCP? An EHCP is an acronym which stands for Education, Health, and Care Plan which is a legal document in the United Kingdom that is there to support children and young people aged 0-25 with special educational needs and/or disabilities.

Every child deserves an education that caters to their unique needs, abilities, and potential. For children and young people with special educational needs or disabilities, an Education, Health, and Care Plan ensures that they receive the support and services necessary to flourish academically and personally.

Does Your Child Have SEN?

The EHCP process starts with identifying children and young people who may require additional support due to special educational needs or disabilities that can’t be met without an EHCP. This can be observations by parents, teachers, medical professionals, or formal assessments. Once the need for support is identified, a request is made to the LA to ask for a needs assessment. This can be done by filling out an application form on the local authority’s website or drafting a letter.

Requesting The Needs Assessment

Parents, carers, the school, or even the young person themselves (if over 16) can start the EHCP process by requesting a needs assessment from the local authority. This request prompts the local authority to evaluate whether an in-depth assessment is warranted. If the LA agree to assess, they will send professionals to assess the child/young person. If not, they may refuse to assess, and you have the option to appeal. You should have an answer within 6 weeks of applying.

The Needs Assessment

A thorough evaluation occurs if the local authority determines that an assessment is necessary. This assessment draws information from various sources, including parents, the individual, teachers, medical professionals, and experts like an Educational Psychologist or Speech Therapist, depending on the child/young person’s needs. Its purpose is to understand the child/young person’s needs and what provision is needed to meet those needs.

Drafting The EHCP

The coordinator will gather all supporting documents from the needs assessment and a panel will usually decide the outcome based on the assessment's findings if an EHCP is necessary. If so, a draft document will be created. This document outlines the child/young person’s specific needs, the desired outcomes, and the range of support and services required to meet those needs. The EHCP will also describe the educational setting best suited to meet the individual's needs

Making Representations On The Draft

The draft EHCP is shared with parents and the child/young person (if applicable). This step allows you to make representations of the plan. Finalising the EHCP

Incorporating the feedback received, the local authority finalises the EHCP. What is an EHC needs assessment?

An EHC needs assessment is how the local authority looks at a child or young person’s education, health, and care needs. This is usually asked for when the usual support at nursery, school, or college is not enough. Parents, young people, and schools can share evidence about the difficulties faced, what support has already been tried, progress so far, and why more assessment is needed. This evidence might include reports from teachers, special educational needs coordinators, educational psychologists, therapists, health professionals, and social care workers. It can also include the child or young person’s own views, goals, and experiences at school.

If the local authority agrees to do an assessment, they collect information from the right professionals and decide if an Education, Health and Care Plan (EHCP) is needed. If the wording is unclear, it can be hard to put the EHCP into action or check if it is working.

Understanding the decision letter

You might disagree with how your child’s needs are described, the support offered, the school or placement named, or if they do not name the setting you asked for. Make sure to read the letter carefully, keep the envelope and any attachments, and note the date you got it. There are deadlines for appeals, so act quickly if you want to challenge the decision.

Preparing a SEND appeal to the SEND Tribunal

If you do not agree with some decisions made by the local authority, you might be able to appeal to the SEND Tribunal. In your appeal, explain which decision you are challenging, why you disagree, and what result you want. A strong case is well-organised, based on evidence, and focused on your child’s needs. Show how your evidence supports the assessment, support, or placement you are asking for. Helpful documents can include professional reports, school records, letters, attendance records, progress data, support plans, costed provision maps, and a written statement from you or your child.

Before you send an appeal, work out exactly what you disagree with. Look at what professionals have recommended and compare it to what is written in the decision letter or EHCP. If support is missing or not clear, write down the wording you want and link it to your evidence. If you disagree about the placement, explain why the named setting is not right or why your preferred setting is better. Stay factual and respectful. The goal is to show why a different decision is needed for your child to get the right education and support, not just to show you are unhappy.

What decisions can you appeal?

In England, you can usually appeal if the local authority refuses an EHC needs assessment or reassessment, refuses to issue an EHCP, issues a final EHCP that you disagree with about needs, support, or placement, refuses to change those parts, or decides to stop a plan. Getting advice early can help you find the right way forward.

SEN mediation and the mediation certificate

In many cases, a parent or young person must consider SEN mediation before registering an appeal. A mediation adviser can explain the process and the options available. You may choose to take part in mediation or, for some types of appeal, obtain a mediation certificate without attending a mediation meeting. The certificate is an important document when lodging the appeal. Mediation can provide an opportunity to clarify disputed issues, share evidence and explore whether agreement is possible. However, families should prepare carefully, understand the outcome they seek and keep a written record of any agreement reached.

Information, advice and support throughout the process

Children and young people should have a say in decisions that affect them. You can collect their views in ways that fit their age, how they communicate, and what they prefer. This could be a written statement, photos, drawings, symbols, a communication passport, or help from a trusted adult. Their hopes, strengths, and daily experiences add important context and should be included with professional evidence. If a disability makes it hard to communicate or take part, make sure to take steps so the child or young person can still be involved.

EHCP - PHASE TRANSFERS

Phase transfer of an EHCP refers to the process of transitioning a student with special educational needs and disabilities from one educational setting to another. This phased approach is used when a student is moving from one school or educational phase to another, such as transitioning from primary school to secondary school, reception to Primary school, infants to juniors etc.

The phase transfer process begins with careful planning and collaboration between the current and receiving educational settings, Local authorities, parents or carers, and relevant professionals involved in your child's support. This includes sharing information, reviewing the EHCP, and identifying the specific needs and support requirements during the transition. We can support you during this stage.

The phase transfer deadlines are 15th February and 31st March (post-16 transfers) for that school year. Keep these dates in your calendar, as a few months prior to these dates, an annual review should be held with the school and local authority to discuss the transition. This is where you can start thinking about naming a suitable school placement in your child's EHCP when you receive a copy of the draft plan.

Continuously monitor and review your child's progress and the effectiveness of the support provided during the phase transfer. Adjustments to the EHCP or support strategies may be necessary based on the student's needs or challenges during the transition. SENDIST stands for the Special Educational Needs and Disability Tribunal . Operating as part of the Health, Education and Social Care Chamber within the First-tier Tribunal, SENDIST is an independent, national judicial body responsible for hearing and determining legal appeals against decisions made by Local Authorities (LAs) across England regarding a child or young person's special educational needs and provision.

When disagreements arise between families and Local Authorities concerning an Education, Health and Care Plan (EHCP) or an initial assessment, SENDIST provides a legal framework to resolve these disputes.-----What Local Authority Decisions Can Be Appealed?

Parents, carers, and young people can lodge an appeal with SENDIST under specific statutory grounds. The tribunal handles appeals concerning:

Refusal to Assess or Reassess: Decisions where the Local Authority refuses to carry out an EHC needs assessment or reassessment for a child or young person.
Refusal to Issue a Plan: Decisions where the Local Authority completes an assessment but refuses to issue an EHCP.
Disagreements Over EHCP Content: Disagreements regarding the contents of a final or amended EHCP, specifically:
Section B: The description of the child or young person’s special educational needs.
Section F: The special educational provision required to meet those needs.
Section I: The educational placement or setting named in the plan, or the type of setting.
Annual Reviews & Cease to Maintain: Decisions made following an Annual Review, or decisions to cease to maintain an existing EHCP.
Health and Social Care Recommendations: Under tribunal powers, SENDIST can also make non-binding recommendations regarding Health (Sections C and G) and Social Care (Sections D and H) when an educational appeal is lodged.

The tribunal framework is built upon three foundational pillars:

Impartiality and Fairness: SENDIST acts as an independent referee. It evaluates each case strictly against education law—such as the Children and Families Act 2014 and the SEND Code of Practice—rather than relying on local authority policies or financial constraints.
Specialist Panel Expertise: Appeal hearings are conducted before an expert panel led by a legally qualified Tribunal Judge alongside up to two specialist panel members with deep experience in special educational needs law, educational psychology, and practice.
Legally Binding Determinations: The decisions issued by SENDIST are legally enforceable. If the tribunal orders a Local Authority to carry out an assessment, issue an EHCP, alter specified support, or name a different school, the Local Authority must comply within fixed statutory timeframes.

Who Can Appeal: For children from birth up to compulsory school age (the end of Year 11), parents or carers submit the appeal. Young people aged 16 to 25 can submit an appeal in their own right, or parents can appeal on their behalf if requested or if the young person lacks capacity.
Statutory Time Limits: An appeal must be received by SENDIST within 2 months from the date on the Local Authority’s final decision letter, or within 1 month from the date on the mediation certificate, whichever date is later.
Mediation Requirement: In most cases, appellants must contact a mediation adviser to consider mediation before submitting an appeal form (SEND35 or SEND35a). Obtaining a signed mediation certificate is mandatory unless the appeal relates solely to the named school or educational setting in Section I.

The standard appeal timeline spans approximately 12 to 16 weeks from registration to the final hearing:

Lodging the Appeal: The appellant completes the appropriate appeal form (SEND35 for EHCP contents/refusals or SEND35a for refusal to assess). This includes submitting grounds of appeal, the decision letter, the mediation certificate, and supporting evidence such as medical, psychological, or therapy reports.
Registration & Timetable: Once accepted, SENDIST registers the appeal and issues Case Management Directions setting key deadlines.
Local Authority Response: The Local Authority is required to submit a formal response setting out its legal stance and supporting evidence.
Working Document & Evidence Gathering: For appeals concerning plan contents, both parties work through a 'Working Document' to negotiate agreed points and highlight remaining disputes. Final evidence (such as expert independent witness reports) must be submitted by the specified deadline.
The Hearing & Decision: Hearings are primarily conducted online via video, though paper hearings or in-person hearings can occur. Both parties present their arguments, reference the compiled appeal bundle, and answer questions from the panel. A written decision is typically issued within 10 working days following the hearing.
